noddienight.com is run by Advanced Community Living Corporation, a New Jersey corporation trading as Noddie Night (“Noddie Night”, “we”, “us”). We are the seller of everything bought on this site.

These terms are the agreement between you and us whenever you use the site or place an order. Our Privacy Policy, Shipping Policy and Refund Policy form part of them. If you do not agree, please do not use the site.

Who can buy

You must be at least 18 years old to buy from us, and Noddie Night is for adults 18 and over only. By placing an order you confirm that you are 18 or older, that the details you give us are accurate, that you are authorized to use the payment method, and that you are buying for personal use and not for resale. We ship to addresses in the 50 US states and Washington, DC.

The product and your health

Noddie Night is an herbal dietary supplement. It is not a medicine.

• Follow the directions on the bottle and on our Product facts page. Do not take more than 2 servings (1 bottle) a day.
• Do not use a bottle if its seal is broken or missing.
• Stop using it and speak to a doctor if you have an adverse reaction. Please tell us too.
• Nothing on this site is medical advice. The site, our emails, our sleep guide and our chat are general information only. They are no substitute for advice from a doctor or pharmacist who knows your health and your medications. Results vary from person to person and we do not promise any particular result.

Prices and availability

• Prices are in US dollars. Shipping is free on every order with USPS Ground Advantage; if you choose a faster service, the difference is added at checkout once you enter your address. See shipping rates.
• No sales tax is currently charged.
• Prices, packs and offers can change at any time, but a change never affects an order we have already accepted. Changes to a Subscribe & Save price are covered below.
• Everything is subject to availability. If something you paid for turns out to be out of stock, we will tell you and refund it in full.
• We try hard to get descriptions, photos and prices right. If we find an obvious pricing or description error, we may cancel the order and refund you in full, or ask whether you would like to go ahead at the correct price.

Orders and payment

• You check out on our site: you enter your delivery details, pick a delivery option from live carrier rates, and then pay on a secure page hosted by Stripe, our payment processor. Your card details go to Stripe, not to us.
• You are charged when you place the order. Your order is an offer to buy. We accept it when we email your order confirmation, and the contract between us is formed then.
• We may decline or cancel an order, for example if we suspect fraud, cannot verify the address or payment, or the order looks like it is for resale. If we cancel an order you have paid for, we refund it in full.
• Please check your confirmation email. If something is wrong, tell us right away, because we can usually fix it before the order ships.
• Card disputes. If you have a problem with a charge, please email us first. We answer within one business day and can normally sort it out faster than a card dispute can. This does not take away any right you have with your bank.

Shipping and risk of loss

Shipping costs, processing times, where we ship and what happens if a package is lost are set out in our Shipping Policy. Delivery dates are carrier estimates, not guarantees. Ownership of the products passes to you when we hand the package to the carrier. Even so, if your order arrives damaged or does not arrive at all, tell us within 14 days and we will replace it or refund it in full.

Refunds and the first-bottle promise

If you try Noddie Night and it is not for you, email us within 30 days of delivery and we will refund the price of one bottle. This applies to your first order only, once per customer or household. Shipping is not refundable, and there is no need to send anything back. The full details, and what we do about damaged, wrong or missing items, are in our Refund Policy. Because Noddie Night is a consumable, we do not otherwise accept returns.

Subscribe & Save

What you are buying

A delivery of the pack you chose, once a month, at 15% off the one-time price:

Shipping is free on every box with the cheapest service, USPS Ground Advantage. If you choose a faster service at checkout, only the difference is added, and the same amount is charged with each monthly box. Your exact monthly total, pack plus any shipping, is shown in the checkout window before you pay and again in your order confirmation email.

Billing

• Your first box is charged when you sign up. After that, your card is charged automatically through Stripe once a month, on the same day of the month you signed up, until you cancel.
• There is no minimum term, no sign-up fee and no cancellation fee.
• We email a receipt every time your plan renews. Each receipt reminds you how to cancel.

How to cancel, skip or pause

There are two ways to cancel, and both are free:

1. By email. Email billing@noddienight.com (that link opens a ready-written cancellation email), reply to any order email, or use our contact form. Include your order number or the email address you ordered with. You can do this at any time before your next billing date. Your cancellation takes effect as soon as we receive it: you will not be charged again. We confirm it by email, normally within one business day, and if a renewal charge goes through after your request reached us, we refund that charge in full.
2. Yourself, online. Your Subscribe & Save confirmation, renewal receipts and any payment-failed email carry a “Manage or cancel your subscription” link. It opens a secure page run by Stripe where you can cancel immediately or update your card. We email you a confirmation, and you will not be charged again after the cancellation date shown there.

To skip a month, pause, or change your pack or address, email us before your next billing date and we will do it for you; these changes are not yet self-service. A box you have already paid for still ships, and our Refund Policy applies to it.

Price changes

If the price of your plan is going to change, we will email you at least 30 days before the first renewal at the new price. You can cancel before that renewal and you will not be charged the new price.

If a payment fails

If a renewal payment is declined, we email you, with a secure Stripe link to pay or update your card where one is available, and Stripe may try the card again over the following days. Nothing ships until the payment succeeds. If payment still cannot be taken, the subscription ends, we tell you by email, and you owe nothing further.

Discount codes

One code per order. Codes have no cash value, cannot be combined or applied after you have paid, and may be limited in number or withdrawn at any time. On a Subscribe & Save plan, a code comes off your first box only. Later boxes are charged at the normal Subscribe & Save price.

Reviews and your content

• If you send us a review, feedback or a photo, you give us a non-exclusive, royalty-free, worldwide license to publish, reproduce and display it on our site, in our emails and in our marketing, for as long as we choose. You still own it, and you can ask us to take it down at any time.
• Reviews appear under the name you enter. Your email address and order number are never shown.
• Reviews must be your own honest experience of the product. Please do not include claims that Noddie Night treats or cures any condition, other people's personal information, or anything unlawful or abusive.
• A person checks every review before it appears. We may decline or remove a review that breaks these rules, but we do not edit reviews to change their meaning, we do not hide a review just because it is negative, and we never write or pay for fake reviews.

Acceptable use

Please use the site only to browse and shop. You agree not to:

• break the law, or use someone else's payment details or identity;
• interfere with the site, probe it for weaknesses, or try to get into areas that are not public;
• use bots or scrapers to place orders, harvest content or flood our forms or chat;
• buy our products to resell them without our written agreement; or
• send abusive, threatening or misleading messages through our forms, chat or reviews.

We may block access or cancel orders where these rules are broken.

Intellectual property

The Noddie Night name and logo, and the text, photographs, films, label artwork and design of this site, belong to us or to our licensors and are protected by copyright and trademark law. You are welcome to view the site and to share links to it. You may not otherwise copy, republish or make commercial use of our content without our written permission.

Disclaimers

We promise that our products are what we say they are and are fit to be sold. Beyond that, and beyond the promises in our Shipping and Refund policies, the site and its content are provided “as is” and “as available”. We do not promise that the site will always be available or free of errors, or that Noddie Night will produce any particular result for you. Nothing in these terms takes away the implied warranties or consumer rights that the law of New Jersey, or of your home state, does not allow us to exclude.

Limitation of liability

We are responsible for loss that is a foreseeable result of our breaking these terms or failing to use reasonable care. Otherwise, our total liability to you in connection with the site or an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses, loss of profit, or loss caused by events outside our reasonable control.

These limits do not apply in New Jersey or anywhere else to: bodily injury caused by a defective product; loss caused by our fraud, gross negligence, recklessness or intentional misconduct; or any right or remedy you have under the New Jersey Consumer Fraud Act, the New Jersey Products Liability Act, the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act, or any other consumer-protection law that cannot be waived by contract.

Indemnity

If someone brings a claim against us because you broke these terms, misused the site, resold our products without permission, or submitted content that infringes someone else's rights, you agree to cover the reasonable losses and costs that result, including reasonable attorneys' fees. This does not apply to the extent that the claim was caused by our own fault.

Disputes and governing law

1. Talk to us first. Most problems are solved with one email. Write to orders@noddienight.com with your order number and what went wrong, and give us 30 days to put it right before starting any legal action.
2. Governing law. These terms, and any dispute about them, the site or an order, are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules.
3. Where claims are heard. Claims must be brought in the state or federal courts located in New Jersey, and you and we both accept the jurisdiction of those courts. Either of us may instead use a small-claims court that has jurisdiction.

Nothing in this section takes away the protection of any consumer law of your home state that cannot be waived by contract.

General

• If part of these terms is unenforceable. If a court finds that any part of these terms cannot be enforced, that part is removed or narrowed as little as necessary, and the rest stays in force.
• Entire agreement. These terms and the policies they link to are the whole agreement between you and us about the site and your orders.
• No waiver. If we do not enforce a right straight away, we can still enforce it later.
• Transfer. We may transfer our rights and duties to a company that takes over the business, provided your rights are not reduced. You may not transfer yours without our consent.
• Events outside our control. We are not in breach if we are delayed by something we could not reasonably control, such as severe weather, a carrier failure or a supplier shortage. We will tell you, and you can cancel an unshipped order for a full refund.
• Notices. We contact you at the email address on your order. You can contact us at the addresses below.

Changes to these terms

We may update these terms from time to time. The version that applies to an order is the one posted here on the day you placed it, and the date at the top shows when it last changed. For Subscribe & Save customers, we email you at least 30 days before any change that affects your plan, and you can cancel before it takes effect.
